Section 76
Can request for arrest
(1) If the commanding officer arrests a person accused of a crime, he may request the Chief District Officer of the district where the accused is located and if such a request is made, the concerned Chief District Officer shall arrest the accused and hand him over to the concerned officer.
(2) The commanding officer of the formation, unit, or sub-unit of the fugitive who has left the service may request the chief district officer to open the details of the fugitive and if such a request is made, the related officer shall arrest the fugitive and hand him over to the concerned officer.
(3) Notwithstanding anything written in sub-section (1) or (2), if the police officer has reasonable grounds to believe that he has deserted the service or has committed any other offense, the police officer shall arrest such person without warrant and hand him over to the Chief District Officer for necessary action. will fall
